Notes about protection of privacy


Privacy policy for OpenEstate.org

This data privacy statement informs users of OpenEstate.org about the type, scope and purpose of the elicitation and usage of personal data. This data privacy statement is based on the German data protection act (BDSG-neu), the General Data Protection Regulation (GDPR) and the German Teleservices Act (TMG).

General remarks

The operator of OpenEstate.org upholds the commitments of the data protection law and respects the privacy of the visitors.

  • All captured data is protected in a highly sophisticated manner with the best of our knowledge.

  • No personal data is forwarded to a third party.

  • While using OpenEstate.org no data is sent to third party servers. If the transfer of personal data is necessary in an isolated case, the users will be informed before any transfer takes place (commonly called „Opt-In“). This ensures, that IP addresses of the users are best possibly protected from third parties.

Personal data

Personal data is any kind of information, that can be used on its own or with other information to identify, contact, or locate a single person, or to identify an individual in context. For example this can be an address, e-mail address, phone number or IP address.

The operator only collects personal informations, if it is necessary for the operation of OpenEstate.org, if it is allowed by law and if the user approves to it.

No collected data is transferred to a third party.

User data

The user data, that is gathered during the registration process, is only used for the purpose of utilizing the services provided by OpenEstate.org. The collected data is apparent from the registration form. These include especially the name, address, company name, e-mail address, phone number.

As long as an account is active the corresponding user data is stored. The recorded user data is deleted, if the corresponding account is cancelled. The operator reserves the right to keep the user data of a cancelled account, if there are concrete indications or eligible suspicions of illegitimate usage until the issue is resolved.

Contacting

Registered users as well as not registered users (resp. anonymous users) may contact the operator through the provided contact form or via e-mail. Any contact requests and resulting communications including personal data are stored by the operator in order to process the request and for the case of possible follow-up questions.

  • For contact requests by not registered users (resp. anonymous users) the IP address and the identification of the web browser (commonly called „User-Agent“) is also stored. These information are used for recognition and protection against potential malpractice (especially Spam). Any resolved contact request including personal data and follow-up communications is removed automatically after eight weeks.

  • Contact requests by registered users are stored as long as the corresponding user account is active. Therefore the user may access previous communication and assistance by the operator through the provided ticket system. The recorded contact requests and follow-up communication is automatically deleted, if the corresponding user account is cancelled.

The operator reserves the right to keep contact requests and follow-up communication, if there are concrete indications or eligible suspicions of illegitimate usage until the issue is resolved.

Comments and contributions

Only registered users may post publicly visible comments or contributions. This feature is an essential part of OpenEstate.org. Any comments and contributions are stored permanently for the purpose of traceability and assistance for other users even after the author's account was cancelled.

No IP addresses are stored together with published comments or contributions. Instead each posting is assigned to the corresponding user account. This assignment is removed as soon as the author's account is cancelled.

If a user does not like to publish his real name together with his comments or contributions, he might enter a pseudonym in his profile. The provided alias name is shown within the user's postings instead of the real name. A user, whose account was already cancelled, may instruct the operator to anonymize the real name in his previously published comments or contributions.

The operator reserves the right to keep comments or contributions, if there are concrete indications or eligible suspicions of illegitimate usage until the issue is resolved.

YouTube videos

Some pages of OpenEstate.org might contain videos, that are embedded from the video platform YouTube (belonging to YouTube LLC, a subsidiary of Google, located at San Bruno, CA, USA). Below these videos there is a notification, that indicates about the external YouTube platform.

After clicking on the video the YouTube servers are connected in order to start video playback.

  • In the process of video playback the IP address of the user and the originating page of OpenEstate.org is sent to the YouTube servers.

  • If the user is logged in at YouTube with his account, the portal will associate the video playback with the YouTube account of the user. The user can circumvent this kind of profiling, if he logs out from YouTube before starting the video playback.

PayPal

Our sponsorship page contains a button of the payment service PayPal (belonging to PayPal (Europe) S.à r.l. et Cie, S.C.A., located at Luxembourg). This provides an easy solution for our users to send donations to the OpenEstate project.

After clicking on the button the user is redirected to a website by PayPal in order to start the donation process. During the payment process the IP address of the user and the originating page of OpenEstate.org is sent to the PayPal servers.

Cookies

A cookie is a small piece of data sent from a website and stored on the user's computer by the user's web browser while the user is browsing. Cookies were designed to be a reliable mechanism for websites to remember stateful information or to record the user's browsing activity.

The public websites of OpenEstate.org are mostly usable without any cookies. Only the contact form, registration form, login form and the internal area (for logged in users) will require cookies to be enabled.

Most modern browsers support cookies and allow the user to disable them. But please consider, that some parts of OpenEstate.org are not usable without cookies.

Server logfiles

Any request to OpenEstate.org is recorded into logfiles (commonly called „Server logfiles“). The recorded data contains:

  • the visitor's IP address

  • identification of the web browser (commonly called „User-Agent“)

  • point in time of the request

  • address of the requested page

  • amount of tranferred data

  • notification about the success of the request

The operator uses these logfiles for detection and elimination of possible malfunctions (especially for protection against Spam and DOS attacks). The operator reserves the right to review the logfiles afterwards, if there are concrete indications or eligible suspicions of illegitimate usage.

The server logfiles are automatically removed after seven days.

Usage statistics

OpenEstate.org uses the software „Matomo“ (formerly known as „Piwik“) in order to keep track of visitors. This allows us to optimize our website and discover possible problems. The IP address is stored anonymously. This means we are not tracking personal data of our visitors.

„Matomo“ makes use of cookies - a small piece of data sent from a website and stored on the user's computer by the user's web browser while the user is browsing. Any information, that is gathered by the tracking cookie is saved on our servers in Germany and is not passed to a third party.

Users may disable tracking in one of the following ways:

  • If the user enables the „Do not track“ feature of his web browser, no statistical data is gathered.

  • An opt-out cookie may be set in order to disable gathering of statistical data.

On this page users of OpenEstate.org can find further information about their current state of tracking and a form to disable / enable tracking by setting an opt-out cookie.

Each user may excercise the following rights related to the storage of his personal data at OpenEstate.org:

  • information about the processing of your personal data;

  • obtain access to the personal data held about you;

  • ask for incorrect, inaccurate or incomplete personal data to be corrected;

  • request that personal data be erased when it’s no longer needed or if processing it is unlawful;

  • object to the processing of your personal data for marketing purposes or on grounds relating to your particular situation;

  • request the restriction of the processing of your personal data in specific cases;

  • receive your personal data in a machine-readable format and send it to another controller („data portability“);

  • request that decisions based on automated processing concerning you or significantly affecting you and based on your personal data are made by natural persons, not only by computers. You also have the right in this case to express your point of view and to contest the decision.

Due to the lack of appropriate standards for a data transfer, the operator can't meet the requirements of an easy data portability in a cost-neutral way. For a tolling fee the operator will provide the requested information in a machine readable format. But the operator can't fully guarantee the further applicability of the provided files by another vendor.

OpenEstate.org does not make use of automated processing (profiling). Therefore these requirements do not apply to the operator.
