General terms and conditions for OpenEstate.org

OpenEstate.org is a moderated social network, that is focused on the development of software solutions for the real estate industry.

With the registration of an account the user enters a temporal unrestricted usage and free of charge contract with the operator of OpenEstate.org. This contract can be cancelled from both sides at any time without previous notice.

Permission of participation

Each company or single person, that is interested in supporting the OpenEstate project, is allowed to participate. There is no legal claim for an activation.

The activation happens automatically with verification of the e-mail address, that was provided during the registration process. This contract becomes effective after the verification was finished.

Moderation

OpenEstate.org is supervised by a team of moderators, that acts in order of the operator. Advices and warnings by the moderators have to be respected by the user.

  • In case of violations against this contract the moderators are qualified to take appropriate sanctions or cancel this contract in the name of the operator if necessary.

  • The moderators are qualified to shut out the user completely, temporarily or permanently, if the user violates against this contract despite an admonition.

  • The moderators are qualified to remove or edit published contents by the user partially or completely, if these contents infringe established law or this contract.

Any contact between moderators and users has to happen privately (non-public) through the provided ticket system.

Profile data

The user is obligated to provide correct informations in his user profile. Possible changes to the personal data have to be corrected shortly.

Netiquette

We're expecting a friendly, respectful and tolerant tone in public and private communication through the OpenEstate.org platform. This is an unalterable requirement for the use of the services provided by OpenEstate.org. The opinions of other users have to be accepted and respected.

Users are allowed to send links to external websites in their submitted contents as long as the linked websites don't violate against established law. The user is obliged to check the contents of linked websites for compliance with all legislation before posting links to OpenEstate.org.

Services

The operator offers the following services to the users of OpenEstate.org.

Provided software

The operator has the copyright and related rights for the software provided for download at OpenEstate.org. The user has to accept the respective terms of use before downloading a certain software.

Discussion forum

The operator provides a discussion forum for a collective exchange of ideas between registered users. For a trouble-free operation of the discussion forum the following requirements are mandatory:

  • We set great value on objective discussions with a polite tone.

  • Search for available discussions before starting a new topic. If a matching topic does already exist, add an answer to the existing topic instead of creating a new topic.

  • If a new topic is created, select the proper keywords for the new topic.

  • If a new topic is created, enter a proper and descriptive subject for the new topic.

  • For reasons of clarity and comprehensibility create one topic for each of your issues. Don't post several different issues / questions into one single topic.

  • Make sure, that your message / answer contains all relevant informations for the reader / recipient.

  • Try to avoid meaningless statements, that don't bring the discussion forward.

  • Exclusively posting links without quotes or a personal text should be omitted.

  • Prove your statements with reasonable references, that other users can verify.

  • Use the quotation feature of the discussion forum. Other ways of quotation (like bold or italic text) are not allowed. Reduce your quotes to the essential information.

  • Quoted content from external websites always have to contain a link to the original source.

  • The user is not permitted to promote his own company or services as long as it is not a valid answer to another user's request.

In case of violations against these rules the moderators are qualified to take appropriate sanctions in the name of the operator if necessary.

Knowledge base

The operator provides a knowledge base for sharing documentation and information between users. Registered users may post documentation on their own.

Users are not allowed to publish contents from the knowledge base outside of OpenEstate.org without a written permission of the operator.

News archive

The operator provides an archive of news about the OpenEstate project.

Users are allowed to copy or quote news outside of OpenEstate.org as long as they provide a link to the original source.

E-Mail notifications

The user permits the operator to send e-mails to the user's provided e-mail address. The operator will send

  • general announcements and notifications, that are relevant for the operation or usage of OpenEstate.org;

  • notifications about the user's subscriptions;

  • communication between the user and moderators through the internal ticket system;

  • information about further projects of the operator.

Author's rights

With the posting of a message or uploading of a file the user confirms, that he holds the necessary rights (copyright or usage right) for publication of the particular content.

Users are allowed to copy or quote publicly available content of OpenEstate.org as long as they provide a link to the original source.

Users are not allowed to copy or quote private content (e.g. messages in the ticket system or private messages) without a written permission of the particular author.

Usage rights

The user grants an unlimited and indefinite usage right for his provided contents (messages or attachments) with naming names to the operator.

Liability

The user is liable for his provided contents (messages or attachments). The operator and moderation do not verify these contents for correctness neither are they responsible for wrong statements.

Any contents, that are not submitted by a user, are verified. Any mistakes, that become apparent subsequently, are fixed or removed as soon as the operator becomes knowledge about them.

The operator assumes no liability for the non-availability of the provided services or a possible damage, that results from the non-availability of the provided services.

The operator assumes no liability for possible program errors or a possible damage, that results from program errors.

The operator and moderators don't give legal or fiscal advice.

Closing remarks

If a provision of this agreement is or becomes illegal, invalid or unenforceable in any jurisdiction, that shall not affect:

  • the validity or enforceability in that jurisdiction of any other provision of this agreement; or

  • the validity or enforceability in other jurisdictions of that or any other provision of this agreement.

The operator is authorized to change these terms of service at any time. Any changes are reported to the users and need to be accepted by the user as soon as he logs in to OpenEstate.org for the next time. If the changed terms are not accepted, this contract is being cancelled and the user is not able to use the provided services anymore.
